Rights

Meaning and purpose

The rights element is a wrapper element that contains descriptions of rights, licences and access rights for a collection, in both text and URI formats. 

Rights, licence and access rights information is displayed prominently on Research Data Australia to support researchers in reuse of research collections.


rightsStatement

A statement about the intellectual property rights held in over a collection, a legal document giving official permission to do something with a collection, or a statement about access rights. Example: Copyright, John M. Smith, 2011

Note: this element is based on the standards listed below, which allow the rightsStatement to also include licence and access right information, therefore this element can contain all of that information or be limited to intellectual property rights if the data provider wishes to split their information.

A URI containing one or more of a rights statement, licence or access rights and constraints relating to the collection.

Copyright statements

  • Copyright in source documents of collection content is held by the content providers - for further details see collection homepage. AustLII claims copyright in its value-adding to source documents, elements of which include hypertext mark-up and alternative citations.
  • Copyright (c) 2008-2010. C. Michael Bull, Flinders University, South Australia.

Combination statement

  • The owner / manager of this data collection may provide access to this data collection by negotiation. You could be required to indicate your intended use of the data, to meet any costs associated with providing you with the data, and to fulfill other terms and conditions as determined by the data owner / manager. Use of the data may also be subject to legal, ethical and commercial restrictions, requiring further permission from other individuals or groups, including ethics committees, project steering groups, and research participants.

accessRights

Description of access rights and constraints, including who may access, when access may occur (including any embargo), and uses that may be made of the collection. Restrictions may be based on security, privacy or other policies.

  • Access is restricted to the project participants until six months after the completion of the project.

  • Individual end-users are free to access, copy and print materials for their own use in accordance with copyright law. For web spidering and other automated collection, access restrictions are set out in the robot exclusion file located at http://www.austlii.edu.au/robots.txt

RIF-CS best practice guidelines

Which version should I use?

In RIF-CS v1.2.0, rights and access rights were provided using the description element and specifying type="rights" or type="accessRights".

Existing feeds containing rights in the RIF-CS v1.2.0 format remain valid and do not need to be changed in any way.

Manually created records or new feeds being established should use the new RIF-CS v1.3.0 elements.

ANDS recommends use of the new rights elements if possible, to:

  • permit use of URLs to point to or identify rights information
  • support search filtering by licence type as a guide to re-use potential
  • allow description of licences and display of associated logos (if available) in Research Data Australia. AusGOAL licences are being adopted widely for public sector data and this practice is expected to be adopted for much research data. More information
